These Terms govern your use of HELM (“HELM”, “we”, “us”), including our web app, mobile app, and supporting services. By using HELM you agree to these Terms. If you don’t, please don’t use the service.
What HELM is
HELM is a fitness and training analysis service. It estimates aspects of your athletic state (fitness, fatigue, tissue load) from data you authorize it to read. HELM is not a medical device. Its outputs are not medical advice and must not be used to diagnose, treat, or prevent any medical condition. Always consult a qualified clinician for medical decisions. Even when a physical therapist uses HELM as part of your care, the clinician (not HELM) is responsible for clinical judgment.
Your account
You must be at least 16 years old to use HELM. You are responsible for keeping access to the email address on your account; whoever can sign in to that email can sign in to your HELM account. You are responsible for the activity that happens under your account.
Acceptable use
You agree not to:
- Reverse-engineer, scrape, or interfere with the service beyond what our published interfaces allow.
- Upload data you do not have the right to share, or impersonate another athlete.
- Use HELM to violate any law, third-party right, or the terms of any service you connect through HELM.
- Use HELM to make medical, employment, insurance, or other consequential decisions about another person.
Your data, your rights
You own your data. We process it on your behalf as described in our Privacy Policy, which is incorporated into these Terms. You can disconnect integrations, export your data, or delete your account at any time.
Subscriptions, trials, and beta
During the private beta, access is by invitation and may include a time-limited free trial. Paid plans, if introduced, will be presented with prices, billing cadence, and auto-renewal terms before you confirm. You can cancel paid plans at any time; cancellations apply at the end of the current billing period.
Service availability and changes
HELM is a live service. We may add, change, or remove features, including breaking changes during the beta. We will give reasonable notice for material changes when we can. We do not guarantee specific uptime or that the service will be free of bugs or interruptions.
Third-party services
HELM connects to third-party data providers (wearables, watches, training apps) so you can use the gear you already have. Your use of those providers is governed by their respective terms. HELM is not responsible for outages, data loss, or policy changes by those providers. If a provider revokes access, the affected integration may stop working.
Intellectual property
HELM, including its software, models, design, and content, is our property or licensed to us. These Terms do not grant you any right to our trademarks or to redistribute the service. You retain all rights in the data you bring to HELM; you grant us a limited license to use it strictly to operate the service for you.
Disclaimers
HELM is provided “as is”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that HELM’s estimates are accurate for any particular individual, decision, or outcome.
Limitation of liability
To the maximum extent permitted by law, HELM and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill. Our aggregate liability for any claim arising out of these Terms or the service is limited to the greater of (a) the amount you paid us in the 12 months before the claim and (b) USD 100.
Termination
You can stop using HELM and delete your account at any time. We may suspend or terminate access if you violate these Terms or use HELM in a way that creates risk for us or our users. We will give notice when reasonable.
Changes to these Terms
We may update these Terms. Material changes will be notified to you by email or in-app at least 14 days before they take effect. Continued use of HELM after the effective date constitutes acceptance.
